Job Title: General Counsel

The General Counsel for the SC Recovering Professionals Program (SCRPP) provides legal counsel to SCRPP staff regarding applicable law and administrative procedure. The General Counsel participates in planning overall legal or administrative activities; handles complex issues, including substantive legal analysis on a regular basis.

Legal and Compliance Review of Correspondence (50%)
• Review and analyze letters and correspondence provided in draft form. Ensure that correspondence provides a full and complete picture of the file in a light that is fair to the participant. Revise and return correspondence to the assigned team member.
• Review and analyze the chart of inconsistencies and/or information that should be added to the correspondence. Confirm that each letter/position aligns with SCRPP policy and applicable law.
• Assess file for any possible legal concerns to include review of participant provided documents, assessment and treatment related documents, internal notes, test results and/or any testing related concerns, and examination from an adverse perspective.
• Draft higher level substantive analysis when requested or perceived necessary.
• Handle requests for SCRPP compliance letters to include individual requests by the participant or a third party; requests for ongoing compliance updates from the major hospital systems.

Provide Legal Oversight and Communication to Stakeholders (25%)
• Receive, and respond to, calls received from attorneys. Intercept communication from attorneys directed to other SCRPP staff. Arrange facts and address issues in a manner that minimizes potential liability.
• Receive, and respond to, calls/communication received from SCDLLR.
• Review and respond to requests for participant files/document production.
• Prepare for, attend, participate, and/or respond to legal issues for RCRC, Advisory Committee, QA, IRC, and SCRPP discharge meetings. Draf and disseminate the IRC decision.
• Attend SCDLLR board meetings including assessment and minimization of any file related deficiencies and/or concerns in advance of each meeting.
• Represent SCRPP before the various boards related to SCRPP policy, board preferences.
• Research and stay knowledgeable concerning state and federal administrative and confidentiality law. Communicate internally and externally as appropriate. Identify and implement internal changes to bring SCRPP into compliance.

SCRPP Leadership and Program Oversight (10%)
• Participate in file auditing to identify internal deficits as a part of continuous improvement and risk mitigation.
• Provide input concerning personnel-related issues and SCRPP policies.
• Participate in planning overall legal/administrative activities including interviewing and talent selection.
• Lead and/or participate in RFP process

Participate in Participant Staffing (10%)
• Attend staffing and provide legal input when appropriate based upon the information provided.
• Review each file as it is presented to confirm that no additional information should be provided.
• Advise staff concerning legal activities.

MARGINAL DUTIES (5%) include the following:
• Attend all required meetings and training sessions.
• Other duties as assigned.

Hiring criteria

• Juris Doctor degree and experience as a practicing attorney.
• Experience managing complex programs is required.
• Must have knowledge of the policies, standards, and procedures of the participating board of LLR.
• Knowledge of the laws of South Carolina and applicable federal law; general case, statutory, and common law; judicial and quasi-judicial procedures and rules of guidance is required.
• Ability to interpret and apply laws in court-related situations is required.
• Ability to plan and/or direct staff concerning the law and legal related activities is required.
• Must be a member in good standing of the South Carolina Bar Association.
